REGULATION OF HYDRAULIC FRACTURING
What’s required, what’s coming, and what’s (possibly) preempted. This presentation will address the general state of the regulation of hydraulic fracturing at the federal, state, and local levels, including how different jurisdictions are taking different approaches to permitting, limiting, and banning fracturing activities based on environmental and permitting regulations. Given the wide disparity in state and local requirements, the presentation will discuss how to assess and approach an analysis of the controls on fracturing in a specific area, and how local restrictions, bans, and limitations may be preempted.
